What Kinds of Arm Injury Can I Claim Compensation For?

Although the arm contains only three bones and a handful of muscles, the variety and complexity of arm injuries that can be sustained is enormous. Damage to the arm can occur in a number of different ways, and identifying what type of injury you have sustained and how it has affected your life will be central to the outcome of your arm injury compensation claim, as your financial settlement will usually be determined by the amount of damage your arm has sustained and the amount of pain and / or disability you subsequently endure as a direct result of your arm injury.

Relatively minor arm injuries can consist of soft tissue (muscle) damage or small fractures to the bones in the forearm or upper arm, known as the ulna, radius or humerus. These typically generally heal fairly quickly and do not cause long-term pain or disability. However, in a minority of cases these apparently minor injuries can cause complications, which often result in increased suffering on the part of the victim and accordingly a greater degree of arm injury compensation as a result.

Some arm injuries consist of much more serious or comprehensive breaks in the ulna, radius or humerus. These will take much longer to heal, or may not even heal completely at all, causing permanent discomfort and disfigurement.

In the worst case scenarios some arm injuries can even require amputation, either above or below the elbow or at the shoulder. These cases are obviously awarded higher levels of compensation, with the exact amount dependent on how much of your arm you have had removed, the wider extent of your pain and suffering, and the impact this has on your life.

Broken Arm

A broken arm is a fairly common injury and is one of the most common reasons for claiming arm injury compensation. Approximately one in every 20 broken arms involve the upper arm bone (humerus), while children are far more likely to break the lower arm bones (radius and ulna). Falling on an outstretched hand, an accident at work or being involved in a road traffic accident are the most common causes of a broken arm, although the injury is just as likely to be caused by something seemingly innocuous as well. Although a broken arm usually heals quickly and causes no long-term issues, it may initially appear deformed and swollen, bruised and bleeding.

Dislocated Elbow

An elbow dislocation occurs when the bones of the forearm (radius and ulna) move out of place compared with the bone of the upper arm (humerus). Serious elbow injuries that can occur when an elbow becomes dislocated include broken bones, damage to the arteries in the arm (the vessels carrying blood to the hand), and injuries to the nerves that run through the elbow area, which can impair movement and feeling in the arm and hand. Although most elbow dislocations are usually the result of a fall, any traumatic injury (such as a physical assault or motorcycle accident) can result in an elbow dislocation.

Bicep Tendonitis

The bicep is located at the front of your upper arm and has two tendons that attach it to the bones of the shoulder and one tendon that attaches it to the radius bone at the elbow. Although these tendons are tough and very resilient, they can become sore and painful if overused – a condition referred to as tendonitis. Tendonitis often occurs as a result of repetitive motion, but it can also occur because of a sudden, traumatic injury to the tendon.
