What Types of Jaw Injury Can I Claim Compensation For?

If you suffer an injury to your jaw – whether it is a fractured jaw, dislocated jaw or an injured jaw muscle, tendon or ligament – and that injury was caused in an accident; as a result of some form of medical or clinical negligence (such as a surgical error or a case of dental negligence), or by a physical assault – you could be entitled to claim personal injury compensation as a result. The amount of compensation awarded will be determined by the type of injury sustained, the amount of pain and discomfort you suffer, your personal circumstances and any loss of earnings caused by the injury.

Broken Jaw

A broken jaw (or mandible fracture) is a relatively common facial injury. In fact, the jaw is the 10th most commonly fractured bone in the human body, and of all the bones in the face, only the nose is broken more frequently. A fractured jaw is generally the result of a direct force or trauma to the jawbone and requires immediate medical attention because of the risk of breathing problems or bleeding. It is also worth noting that a significant percentage of people who suffer broken jawbones also have associated head injuries, as well as potential injuries to the neck, face, eyes, and nose. This can also affect the level of personal injury compensation awarded.

Dislocated Jaw

A dislocated jaw is where the lower part of the jaw has moved out of its normal position at one or both joints where the jaw bone connects to the skull (temporomandibular joints). A dislocated jaw usually heals well, but there is an increased risk of dislocation in the future. If the jaw is dislocated, it can sometimes be realigned without the need for surgery. If the jaw does become dislocated it may need to be stabilised, which usually involves bandaging the jaw in order to prevent the mouth from opening. Where repeated jaw dislocations occur, surgery may be required.
