The latest figures published by the Office for National Statistics (ONS) show that coronavirus related deaths occurring in care homes in England and Wales have risen slightly for the second week in a row.
The figures highlight the potential for a surge in care home claims should negligence have resulted in the premature death of an individual.
There were 43 COVID-related deaths occurring in care homes in England and Wales in the week ending August 21st 2020, which represented an increase of three compared to the previous week, when they had increased for the first time in four months. COVID related deaths in care homes as a proportion of all deaths in care homes also increased from 2% to 2.2%.
Whist it may be viewed that the figures are relatively low, the ONS reported that of all deaths involving COVID-19, 29.6% occurred in care homes. This highlights the importance of ensuring rigorous measures are in place in order to minimise the amount of deaths occurring within these settings in order to reduce the potential scope for care home compensation claims.
These latest figures by the ONS come at a time when it has been revealed that during the first 16 weeks of the coronavirus outbreak, there were 79% more deaths in care homes than seen on average in the previous five years in England. Those in care homes typically fall into higher risk and more vulnerable categories due to their age and likelihood of having an existing medical condition. As a result, a failure to provide protection may lead to an increase in the number of care home compensation being paid out.
Commenting on the number of care home related deaths Mike Padgham, Chair of The Independent Care Group, said: “We have to be on our guard in care and nursing homes and keep our residents and staff as safe as we can from COVID-19.It is also a reminder to the Government that the dangers in care and nursing homes have not gone away and our need for support is as great as ever.”
Medical negligence solicitors Blackwater Law have experienced claims against care homes for a number of reasons and understand that for those with families or loved ones in a care home may want to seek specialist legal advice should they believe negligence has taken place.
