Significant Settlement Valued at Over £200,000 for Mother Following Traumatic Birth and Negligent Post-Operative Care

Jason Brady, Partner and Head of Medical Negligence secured a settlement in excess of £200,000 for a mother who suffered life-changing physical and psychological injuries following a series of failures during her daughter’s birth.

His client, Mrs J was admitted to Hospital in October 2018 to induce labour. Despite a lack of progress over several days and signs that the baby was large and impacted, medical staff failed to implement a proper care plan or perform timely obstetric reviews. Crucially, when a Caesarean Section was eventually discussed, Mrs J was not adequately counselled on the risks of continuing a vaginal birth, leading to a delay in surgery.

When the Category 2 Caesarean Section finally took place, the baby’s head was severely impacted. The delay with the surgery and failures during the surgery resulted in a severe haemorrhage, with Mrs J losing 3000ml of blood and a larger surgical wound and longer surgery with greater risk of infection

The negligence continued post-operatively. Despite signs of sepsis and low blood pressure, hospital staff failed to escalate her care or action specialist referrals for four days. This delay caused the surgical wound to become necrotic, requiring Mrs J to suffer an open wound for a prolonged period and to undergo two painful debridement procedures and have a prolonged stay in hospital.

Jason Brady investigated the multiple breaches of duty, and the Trust admitted to failures regarding the escalation of wound care and test results. Mrs J has been left with permanent abdominal scarring and chronic pain, urological issues, and ongoing psychological trauma. Jason Brady obtained extensive expert medical evidence and secured a settlement of £200,000 reflecting the severity of these injuries and the long-term support Mrs J now requires.
