New figures obtained by Blackwater Law under the Freedom of Information Act show a significant rise in clinical negligence claims relating to paediatrics across NHS Trusts in England, highlighting ongoing concerns around patient safety in children’s healthcare.
Data provided by NHS Resolution reveals that the number of claims received relating to paediatrics increased from 175 in 2021/22 to 213 in 2024/25, a rise of more than 20% over four years. In total, 757 claims relating to children were received during this period. However, not all these claims may go on to be successful.
The data also highlights the serious nature of many of these cases. Fatal incidents consistently accounted for a significant proportion of claims, ranging from 33 to 37 cases per year. Claims whereby the primary injury was brain damage were also significant, reaching 23 cases in 2024/25. Other common causes include unnecessary pain and suffering, as well as additional or avoidable surgical procedures.
These types of claims often involve severe, life-changing outcomes for children and their families, underlining the importance of timely diagnosis, appropriate treatment, and effective clinical decision-making.
It is however important to note that there can be a significant time delay in the incident occurring and the claim being made, for example if the individual is unaware of the negligence. For this reason, it shouldn’t be interpreted as an increase in the number of claims from year to year.

A significant proportion of the claims also involve serious injuries, including brain damage and fatalities. This date reveals a concern for patient safety in children’s healthcare.
If the treatment provided to a child falls below the accepted standard and they have suffered harm, then a claim for may be able to be pursued on their behalf.”
