Partner and Head of Medical Negligence, Jason Brady secured a six-figure settlement on behalf of his client Mrs J, who has suffered long-lasting injuries as a result of negligent care and treatment over a 10 year period.
Mrs J was diagnosed with mixed urinary incontinence and was referred for physiotherapy. However, she continued to experience ongoing symptoms including back and leg pain. Mrs J was then referred for a transurethral tape procedure (TVT-O). Despite a number of other alternative options being available, Mrs J was not advised of these.
Following the surgical procedure, Mrs J began to experience urinary retention and was required to undergo further surgery to divide the tape.
For the years following, Mrs J continued to experience severe symptoms including recurrent urinary tract infections, pain and bleeding. She was subsequently diagnosed with mild hydronephrosis and a polyp on the bladder. This required surgical treatment, where it was discovered that she had eroded and infected vaginal mesh. This mesh was removed. However, her pain and symptoms continued and she underwent further surgery some months later where it was discovered that there was still remaining infected mesh. This was removed.
Jason Brady obtained extensive medical evidence where it was argued that there was negligence in failing to offer and advise Mrs J on alternative treatments, many of which were low risk and less invasive with high success rates. By the point in which Mrs J underwent the TVT-O procedure the adverse risks were well known within the medical industry and had she known of these options, she would not have consented to the surgery.
The poor fitting of the tape led to Mrs J requiring additional surgical procedures and permanent injuries including chronic pain and urinary symptoms.
The Trust denied liability in full. However, the extensive medical evidence supported Mrs J’s claim and an initial offer was made. Given the severity of her symptoms and the duration in which the case spanned, Jason was able to negotiate and secure a higher settlement on behalf of Mrs J.
