Senior Associate Anna Watson successfully secured a settlement on behalf of her client, Mrs A who suffered severe symptoms as a result of a retained placenta following the birth of her child.
Mrs A, had a normal vaginal birth at hospital with physiological management of the placenta. Mrs A and her baby were then subsequently discharged home.
Over the coming days and weeks, Mrs A encountered a number of symptoms including pain, fever and heavy bleeding. Her midwife referred her back to hospital where investigations revealed that the placenta was not complete when delivered. Due to the retained placenta, Mrs A suffered an infection which resulted in further surgery and severe scarring to her womb causing her to developed ‘Asherman’s Syndrome’. One of the devastating consequences of Asherman’s Syndrome is that Mrs A has now been left unable to have any further children.
Anna was instructed by Mrs A in 2022, and despite the Trust initially denying liability, was able to secure an out of court settlement having used supporting medical evidence to highlight how the Trust had failed to complete adequate checks when the placenta was delivered.
