Specialist medical negligence solicitor Thomas Kamlow successfully secured a settlement on behalf of the family of Mrs K, who unfortunately passed away following a fall in a care home.
Mrs K was a resident of a care home, receiving specialist care to manage her dementia. She sadly suffered a fall in the resident dining area and was found on the floor with lacerations to her head. She had been left on her own for an extended period of time. Due to her frailty, she required additional measures to protect her from suffering from falls which were not in place. She fell whilst trying to stand from a chair unaided after being seated for a long period of time.
Mrs K was taken to hospital where it was discovered that she sadly suffered a bleed to the brain. Mrs K remained in hospital for 2 weeks, where due to her frailty she went on to suffer from hospital acquired pneumonia.
Unfortunately, Mrs K passed away due to the hospital acquired pneumonia.
Thomas Kamlow investigated the care records and instructed an expert in nursing care. The investigation concluded that Mrs K required a care plan to place her under close observation at all times, she should have been assisted when being seated and on standing to prevent her from sustaining a fall. The failures by the care home to adequately safeguard Mrs K led to her suffering the fall and later on developing hospital acquired pneumonia. In order to establish this, multiple medical experts were consulted including a nurse expert and respiratory physician to make the link between the brain injury that she sustained from the fall, and the development of the fatal pneumonia.
Thomas Kamlow successfully negotiated a settlement for the family to reflect the loss of life due to the negligence.
