Senior Chartered Legal Executive Anna Watson was able to secure more than £400,000 for her client after her husband died from negligence in hospital.
Our Client’s Husband, Mr S was admitted to hospital in 2019. He was suffering from lower rectal cancer and was referred for a colonoscopy. Following the procedure, a biopsy was conducted and was eventually diagnosed with adenocarcinoma. Thankfully the tests did not show signs that the cancer had spread.
The following month, he underwent surgery to remove the cancer and the procedure went well. Following the surgery, on the 9th day of recovery, he complained of pain in his left calf.
This was reported to the doctor, who was then going to arrange an ultrasound, in order to test for deep vein thrombosis (DVT). Before the test took place, he went to the toilet, aided by his brother and collapsed. Despite resuscitation attempts Mr S died.
It transpired that following the original surgery, blood thinners were not prescribed by the hospital. Furthermore, upon there being a suspicion of DVT, anti-coagulant medication should have been given as a precaution, and not waited until after an ultrasound.
As a result of the negligence, Mr S died because of a blood clot caused by DVT. It is likely that had he not suffered from the blood clot, Mr S would have recovered well from the surgery and the rectal cancer would not have returned.
Anna Watson was able to successfully secure compensation for her client, after the hospital trust admitted liability for the incident, and agreed to a joint settlement meeting.
