More than £10,000 awarded to our client following a ‘Never Event’.

Medical negligence solicitor Benjamin Ho was able to secure more than £10,000 for his client after they suffered from a never event following hip surgery.

Our client, Mrs N was unfortunately suffering from cancer, which had spread through her body and was now affecting the tibia and fibula bones in her leg with lesions. These lesions were causing great pain and affected the structural integrity of the bones.

Plans were made for her to undergo an intramedullary nail, to strengthen and stabilise the bones.

Unfortunately, whilst waiting for this operation, Mrs N suffered from a fall resulting in a broken hip. She required an open reduction internal fixation procedure to repair the hip.

Following the hip surgery, a lump was noticed at the operation site, upon further inspection using X-ray, it was found that the tip of a screwdriver had broken off from the tool used in the hip operation and had been left inside her leg.

Our client required further surgery to remove the piece of surgical equipment resulting in significant delays to the original procedure intended to strengthen her tibia and fibula.

Due to the delay, our client experienced unnecessary pain and suffering. She was forced to bear weight on the cancerous leg whilst waiting for this surgery which caused significant discomfort.

The ‘never event’ delayed her surgery and increased the likelihood of the tibia and fibula becoming increasingly compromised by the spread of cancer.
